Micro Subdivision Housing Development in High-Density Inner Urban Areas of Bangkok: Legal Loopholes, Regulatory Adaptation, and Implications for Land Subdivision Policy

Abstract
Small urban land parcels in the high-density inner-city areas of Bangkok are increasingly being developed into a new form of low-rise housing referred to in this study as Micro Subdivision Housing Development. These projects typically comprise fewer than ten subdivided plots and therefore proceed under the Building Control Act (2001) rather than the Land Development Act (2000). This study investigates how existing regulatory frameworks influence the emergence of this development pattern through a qualitative multiple case study of ten projects located in the Phaya Thai and Chatuchak districts. Documentary analysis, comparative legal analysis, and cross-case analysis were employed to compare the physical characteristics of the projects with statutory land subdivision requirements. The findings indicate that parcel geometry, rather than parcel area, is the principal constraint on inner-city residential development. Developers have responded by adopting alternative regulatory pathways and vertical building designs that maximize land-use efficiency while remaining compliant with existing legislation. The study also identifies an institutional mismatch between the Land Subdivision Act, the Building Control Act, and the Bangkok Comprehensive Plan, resulting in regulatory gaps relating to infrastructure provision and long-term community planning. The findings suggest that Micro Subdivision Housing Development should be understood as a legally compliant adaptive response to changing urban land conditions rather than as informal or illegal development. They further indicate that the current regulatory framework, originally designed for large-scale suburban housing estates, no longer adequately reflects the realities of high-density inner-city development. Accordingly, the study recommends reviewing the existing regulatory framework by introducing standards specifically tailored to small-scale urban housing developments and strengthening the integration of land subdivision, building control, and urban planning regulations.
